摘要
非同质化通证(NFT)有望成为元宇宙与现实世界最有价值的经济流通连接器。NFT在虚拟现实世界的转移并生成对应财产称为映射行为,亟须构建数字法制促进NFT映射合法合规。债权履行、物权变动、知识产权转移、数据可携带权无法规制NFT映射行为,鉴于此,探索信息产权视阈下依照新型网络虚拟财产权说构建“新兴”权利——NFT映射权。映射权构建路径应明确主体、客体、权利内容及权利保护等,任何人均可成为映射权主体;参与映射及映射完成的NFT属于映射权客体;映射权规制元宇宙内NFT区块链间跨链映射、NFT从元宇宙映射到现实世界、实体资产从现实世界映射成元宇宙内NFT,并规范生成、读取、保有、存储、处分、修改、备份NFT财产转移的数据和信息记录等行为;映射权的保护可通过民事、刑事及行政法律途径实现。
Non-fungible token(NFT)is expected to be circulated in the metaverse and the reality of the world’s most valuable economic connector.The transfer and generation of corresponding assets by NFTs in the virtual reality world is called mapping behavior,and it is urgent to build a digital legal system to promote the legal compliance of NFT mapping.In view of the fact that there is no legal regulation of NFT mapping behaviors for debt performance,property rights changes,intellectual property rights transfer,and data portability rights,in view of this,exploring information under the perspective of property rights in accordance with the new type of network virtual property rights theory builds emerging power—NFT mapping right.Mapping the right to build path should be clear subject,object,right content and right protection and so on,anyone can become a map right main body.Participating in mapping and mapping done NFT belongs to the right object.The mapping right regulates the cross-chain mapping between NFT blockchains in the metaverse,NFT mapped to the real world from metaverse,real assets from real world map into metaverse of NFT,with specification generated,read,retain,store,dispose of,modify,backup NFT property transfer data,information and records,etc..Mapping rights protection can be realized through civil,criminal and administrative legal way.
