损害海南自贸港营商环境行为追责机制体系化研究——基于类型化分析的视角

Research On the Systematization of the Accountability Mechanism for Damage to the Business Environment of Hainan Free Trade Port:From the Perspective of Type Analysis

损害营商环境行为追责既体现了中央立法的精神,也是众多地方立法的要求。海南自由贸易港的立法与实践在此问题的表述不统一、类型化不充分,导致了责任追究机制上的不协调。需要在总结现有追责机制的规范和政策依据的基础上,结合对需追责行为类型化分析的科学结论,把握下一步损害海南自贸港营商环境追责行为的重点和难点。国内现有营商环境地方立法对追责机制规定的多元化为海南自贸港的相关工作提供了可借鉴模式,同时也表明现有立法在此方面的意图不统一。损害海南自贸港营商环境行为追责机制的体系化,源于对需追责行为类型化分析的科学划定,同时结合现有立法,将相关监督条文的设计细化,针对特殊主体强化监督追责以及统筹监督追责思路,以期达到追责效果上的统筹兼顾。

Accountability for acts damaging the business environment is not only the spirit of central laws,but also the requirement of many local rules.The legislation and practice of Hainan Free Trade Port are not unified and the classification of this issue is not sufficient,resulting in the incongruity of the accountability mechanism.On the basis of summarizing the norms and policy basis of the existing accountability mechanism,and combining with the scientific conclusion of the analysis of the types of behavior to be held accountable,it is necessary to grasp the key points and difficulties of the next step of damage to the business environment of Hainan Free Trade Port.The diversification of the provisions on the accountability mechanism in the existing domestic local legislation on business environment provides a model for the relevant work of Hainan Free Trade Port,and also indicates that the intention of the existing legislation in this regard is unclear.The systematization of the accountability mechanism for acts that damage the business environment of Hainan Free Trade Port stems from the scientific definition of the type analysis of the acts that need to be accountable,and at the same time,in combination with the existing legislation,the design of the relevant supervision provisions is refined,and the idea of strengthening supervision and accountability and integrating supervision and accountability for special subjects is strengthened,with a view to achieving overall consideration in effect.
