数字贸易时代,电子商务的蓬勃发展和广泛应用令数据跨境流动成为关注焦点。各国政府在网络空间安全保障、网络个人信息保护以及跨境数据流动管制等新兴议题上面临前所未有的挑战。数据本地化措施越来越普遍地出现在各国国内数据流动的管理规则之中,国际社会主要经济体越来越多地以各自不同的方式要求数据本地化,令全球数据市场愈发呈现碎片化态势。以网络安全保障为目的,实现数据安全有序跨境流动,需要把握好数据本地化程度与利益保障需求之间的平衡;实行数据本地化措施不必然导致公民隐私、网络安全或是经济利益等权益受到侵害。

The digital era brings cross-border-data-flow to the center of the stage through the prosperity of electronic commerce(E-commerce).Governments are facing challenges raised by interactions of cybersecurity,personal information protection,and cross-border data flow.As one of the essential approaches to restraining data from transferring abroad by electronic means,diverse data localization requirements are gradually and vastly introduced into domestic data regulations,reshaping the international data governance landscape.To guarantee data flow in an orderly fashion,it is critical to keep the balance between data localization and the other interests.In addition,the implementation of data localization regulations will neither necessarily lead to violations of the right to privacy,nor jeopardize cybersecurity or other economic interests.
