知识产权法定赔偿制的适用困境及完善路径——以加强知识产权司法保护助力辽宁智造强省建设为视角

实施辽宁创新驱动发展战略、加快智造强省建设对我省知识产权的司法保护提出了更高要求。梳理中国裁判文书网中涉及知识产权纠纷的300份司法文书,可以更为直观地发现辽宁省涉装备制造、产业升级类知识产权侵权损害赔偿案件存在法定赔偿适用比例偏高、社会公众对适用法定赔偿确定的赔偿额认可度偏低等实际问题。以实现创新驱动发展、产业转型升级为出发点,构建以知识产权商业价值为基础的赔偿额量化体系,细化完善适用法定赔偿的举证和证据采纳规则,加强法定赔偿考量因素的庭审调查辩论和裁判文书说理,实现法定赔偿社会化,可以更好地解决当前知识产权法定赔偿制在适用中存在的问题,助力辽宁加快推进智造强省建设。

Implementing the strategy of innovation-driven development in Liaoning and speeding up the construction of intelligent manufacturing province have put forward higher requirements for the judicial protection of intellectual property rights in Liaoning.Combing through nearly 300 judicial documents related to intellectual property disputes on the judicial documents network in China,it can be found more intuitively that there are some practical problems such as the high proportion of legal compensation and the low recognition of the amount of compensation determined by the public in the cases of compensation for intellectual property rights infringement involving equipment manufacturing and industrial upgrading in Liaoning Province.Taking innovation-driven development and industrial transformation and upgrading as the starting point,constructing a quantitative system of compensation amount based on the commercial value of intellectual property rights,refining and perfecting the rules of proof and evidence adoption for applying legal compensation,strengthening the court investigation debate and the reasoning of the judgment documents on the consideration of statutory compensation,and socializing the legal compensation can better solve the problems existed in the application of the current legal compensation system of intellectual property rights,and help Liaoning to accelerate the construction of intelligent manufacturing province.
