论著作权合理使用制度的开放化路径

On the opening path of the fair use system of copyright

2020年修订的《中华人民共和国著作权法》通过引入一般条款和兜底条款完成了向开放式立法模式的转变,增强了合理使用制度的灵活性。但一般条款的规定过于宽泛且未明确与特殊条款的关系,在法律适用上可能存在不确定性。可以借鉴四要素分析法完善一般条款的规定,明确一般条款与特殊条款的关系,建立规范意义上的开放化合理使用制度。

The Copyright Law of the People s Republic of China,revised in 2020,completed the transition to an open legislative model by introducing general clauses and minimum clauses,and enhanced the flexibility of the fair use system.However,the provisions of the general clauses are too broad and the relationship with the special clauses is not clear,and there may be uncertainty in the application of law.We can learn from the four-element analysis method to improve the provisions of general clauses,clarify the relationship between general clauses and special clauses,establish a standardized and open fair use system.
