论中华传统生态文化在环境法治中的转化与创新

On the Transformation and Innovation of Traditional Chinese Ecological Culture in Environmental Law Governance

构建生态文明社会,推动我国环境法治建设,离不开中华优秀传统生态文化的支持助力。传统生态文化的核心价值系“天人合一”,蕴含“道法自然、仁爱万物、参赞化育、节欲御用、三才相盗”等丰富内容,深具整体主义理论意蕴。“天人合一”可以为现代环境法治提供系统论与整体主义理论观照与思想启示,为环境法治实施获得公众认同与接受提供良好社会土壤,为现代环境法律制度创新与完善提供本土资源理论给养,为全球环境治理的集体行动贡献中国传统智慧。实现优秀传统生态文化在现代环境法治中转化与创新,需要将其与马克思主义原理有机结合,探索论证“天人合一”与“人与自然生命共同体”等领域的价值对接及其实现方法,赋予其时代生命力,进而将其有机融入气候变化应对、环境教育、国家公园等现代环境法律制度理念中,从而为其在环境法治领域“双创”目标实现提供可行路径。

Building an ecological eivilized society and promoting the environmental law-goverming con-struction cannot do without the support of excellent traditional Chinese ecological culture.The core value of traditional eological culture is"the unity of nature and man",which contains rich ideas such as"respecting nature,caring for all things,understanding breeding and changes,prohibiting greed and control,and heaven,earth,all things and man depending on each other",which has deep theoretical implications of ho-lism.The idea of"unity of nature and man"can provide the theory observation and ideological enlightenment of system theory and holism for moder environmental law govermance,offer good social soil for the publie rec-ogition and acceptance of the implementation of environmental law govemance,supply the inmovation and im-provement of modern environmental legal system with local theoretical support,and contribute traditional Chi-nese wisdom to the collective action of global env ironmental goverance.To realize the transformation and in-novation of the excellent traditional ecological culture in the modern environmental rule of law,we need to combine it with Marxist principles organially,explore and demonstrate the value matching of fields like"the unity of nature and man"and"the life community between man and nature!"and their realization methods,50.as to endow it with vitality of the times.Then,it can be organically integrated into the modern environmental legal system concepts such as climate change response,environmental education and national parks,so as to provide a feasible path for the realization of the goal of"mass entrepreneurship"in the field of environmental law governance.
