数字时代人脸信息保护的困境及其法律对策

The Dilemma of Face Information Protection in Digital Age and Its Legal Prevention

人脸识别技术给人们生产生活带来便利的同时,也存在着过度采集和数据泄露的风险,数字时代人脸信息保护无论是立法层面还是司法层面都存在着重重障碍。而建立专门领域的法律体系;完善未成年人数据侵权的救济机制;引入“数据合规师”,加强行政惩处力度;培养法律科技人才,鼓励多部门联合办案等措施,能够有效的破除障碍,实质性的保障数字时代人脸数据安全。

While face recognition technology brings convenience to people's production and life,it also has the risk of excessive collection and data leakage.There are many obstacles in the protection of face information in the digital age,whether in legislation layer or in judicature layer.In order to break down the barriers effectively and protect the face information substantially,this paper provides the following measures:establishment of a specialized legal system,improvement of the relief mechanism of juvenile data infringement,introduction of"data compliance engineer",strengthening of the administrative punishment,training of legal science and technology personnel,and encouragement of multi-department joint-handling of cases.
