论数据时代检警数据共享的衔接机制

数据时代警察主导模式下检警衔接面临信息不对称、技术力量分散与侵犯隐私权风险的新困境,进而成为司法实践中检察机关退回补充侦查、辩护律师会见阅卷繁琐的重要成因。滥觞于证明标准诉讼规律的检警一体理论似乎能够为解决诸多困境提供理论支撑,然而其与我国传统检警关系与司法实践存在抵触暂不可能付诸实践。借鉴检警一体理论的合理因素加强检警衔接紧密性,强化检察引导侦查,在数据共享视域下通过数据共享、整合科技力量、加强对数据技术侦查手段监管等途径完善数据时代检警在诉讼程序中的衔接配合。
