区域协同立法基本问题研究——基于“京津冀”地区协同立法实践分析

Basic Issues of Regional Coordinated Legislation:Based on the Analysis of Coordinated Legislative Practice in the Beijing-Tianjin-Hebei Region

党的二十大报告对重点领域立法这一司法文明构成要素提出了新要求。其中,推进区域协调发展立法是重点领域立法的题中应有之义。协同立法本身存在三个基本问题:第一,区域协同立法的方式选择;第二,区域协同立法的领域难以确立;第三,区域协同立法执行监督困难。本文旨在系统分析“京津冀”地区协同立法实践经验基础上,就协同立法协作机制、信息交流共享、执法监督、内部利益表达等方面进一步优化,以此完善区域立法体系,推动我国司法文明建设。

The report of the 20th National Congress of the Communist Party of China has put forward new requirements for legislation in key areas,which is a constituent element of judicial civilization.Among them,the promotion of legislation for coordinated regional development should have a seat.There are three basic problems with coordinated legislation:the choice of the method of coordinated regional legislation,the difficulty of establishing the areas of coordinated regional legislation;and the difficulty of monitoring the implementation of coordinated regional legislation.The purpose of this paper is to systematically analyze the practical experience of collaborative legislation in the Beijing-Tianjin-Hebei region and further optimize the collaborative legislation mechanism,information exchange and sharing,law enforcement supervision,and internal interest expression,so as to improve the regional legislation system and promote the construction of judicial civilization in China.
