地方立法吸收民间规范的法理分析

民间规范是地方法治中最重要的辅助规范,地方立法应突出其地方性,关注并吸收被当地公民普遍接受并运用的民间规范。立法以及地方立法吸收民间规范,在法学理论上,不同法学流派的学者多有论述;在法律上,已然具有一定的规范根据。在我国,地方立法吸收民间规范,既有必要,也有可能:必要是因为民间规范集中表现着法治以及地方法治的社会基础,可能是由于民间规范不仅广泛存在,而且治理作用明显,并且我国既有法律对地方立法吸收民间规范提供了一定保障。地方立法吸收民间规范,需要遵循民间规范的系统调查、内容识别和具体吸收等基本方法。

The folk norm itself is the most important auxiliary norm in the rule of law and local rule of law.Local legislation should highlight its local characteristics,pay attention to and absorb the folk norms widely accepted and applied by local citizens.In legal theories,different schools of law have discussed whether and how to absorb folk norms in legislation and local legislation.Also,there has been a certain normal basis in law.In China,it is necessary and possible for local legislation to absorb folk norms.It is necessary because folk norms intensively show the social basis of rule of law and local rule of law.Folk norms not only exist widely,but also work effectively in reality.Also,the existing laws of China provide a certain guarantee for local legislation to absorb folk norms.To absorb folk norms in local legislation,it is necessary to follow some basic methods or procedures,i.e.,the systematic investigation,content identification and specific absorption of folk norms.
