彭真同志是我国社会主义法制的主要奠基人。刚刚过去的2022年,是我国现行宪法颁布施行40周年,也正逢彭真诞辰120周年纪念。回到我国社会主义民主与法制建设历史新时期的开端,彭真主持了现行宪法的起草过程。他在五届全国人大五次会议上就宪法修改草案所作的报告,迄今仍是我们学习和理解我国根本法的重要文献。在彭真同志生前和身后,中共中央文献编辑委员会等机构曾出版彭真文献多种,主要有文集三部,分别是《彭真文选》《论新中国的政法工作》《论新时期的社会主义民主与法制建设》,并在2012年即彭真同志诞辰110周年之际,出版了五卷本《彭真年谱》和四卷本《彭真传》。这些权威文献忠实记录了彭真同志一生的所述、所为和所思,是法学界研究我国社会主义法制历史和实践的重要文献。

Peng Zhen was the key founder of China's socialist legal system.The year 2022 marks the 40th anniversary of the enactment and implementation of the current Constitution,and the 120^(th) anniversary of Peng Zhen 's birth.Peng Zhen presided over the drafting process of the present constitution.His report on the draft amendment to the Constitution delivered at the Fifth Session of the Fifth National People's Congress is still an important document for studying and understanding of this fundamental law.During his lifetime and after his death,the Editorial Committee of the CPC Central Committee and other institutions published a variety of documents related to Peng Zhen,including three collections,namely Selected Writings of Peng Zhen,On the Political and Legal Work of New China,and On Socialist Democracy and Legal System Construction in the New Era.In 2012,the 110^(th) anniversary of Peng Zhen's birth,the five-volume“Peng Zhen Chronology”and the four-volume“Peng Zhen Biography”were published.These authoritative documents faithfully record what Peng Zhen said,did and thought in his life,which are important documents for the legal community to study the history and practice of socialist legal system in China.There are four written articles,which systematically put forward and deeply discuss many important theoretical issues of constitutional jurisprudence around the legal methodology embodied in literature related to Peng Zhen:how to“think like Peng Zhen”,how to construct the historical document system of Chinese Constitution research and make internal systematic interpretation,how to promote the integration of constitutional jurisprudence,republic history and Party history research,how to work hard on historical materials to make them“live”,how to“empathize”with the framers in the history.The theoretical integration of these specific and diverse research topics is not only helpful to enhance the subjectivity of constitutional law research,but also to promote the historical continuity of socialist legal system construction.
