司法档案中的婚姻纠纷与社会变迁--以陕甘宁边区陇东分区妇女为中心的考察

Marital Disputes and Social Changes in Judicial Archives--An Investigation Centered on Women in Longdong District of Shaanxi-Gansu-Ningxia Border Region

梳理陕甘宁边区高等法院和陇东分区司法处的相关档案可以发现,随着边区各项事业的稳步推进,因包办买卖婚姻问题而引发的诉讼纠纷日趋增多。值得注意的是,这些纠纷中有很大一部分比例是由妇女提出的。一向逆来顺受的中国妇女敢说“不”,无论如何都是历史上的巨大进步,既昭示着民众法律意识的普遍增强,也体现出社会经济关系的微妙变化,是社会进步的表现,并为中国共产党进一步完善婚姻法律制度创造了条件。

Combing through the relevant archives of the High Court of Shannxi-Gansu-Ningxia Border Region and the Judicial Office of Longdong District,it can be found that with the progress of various undertakings in the border area,litigation disputes caused by arranged marriage are increasing.It is worth noting that a high proportion of these disputes are initiated by women.The fact that,Chinese women,who have always been meek,dare to say“no”that time is a great progress in history.It not only shows the general enhancement of legal awareness of the people,but also reflects the subtle changes in social economic relations,and is the inevitable result of social development and progress.
