论人民法院家庭教育令的司法适用

2022年1月实施家庭教育促进法后,各地人民法院不断探索家庭教育令制度。法院向怠于履行家庭教育职责的父母发出家庭教育令,有效保护未成年人的合法权益。司法实践中的家庭教育令制度在内容的具体化、法律效力、对义务人的支援措施等诸多方面存在问题。为提高家庭教育令制度效果,有必要对相关问题给予完善,包括义务内容具体化、合理确立违反义务的处罚措施、统一家庭教育令的时间效力以及完善家庭教育指导制度等。

After the Family Education Promotion Law has been implemented in January 2022,local people's courts continue to explore the family education order system.The court issues family education orders to parents who are negligent in performing their family education duties,effectively protecting the lawful rights and interests of minors.In judicial practice,the family education order system has problems in many aspects,such as the concretization of content,legal effect,and support measures for obligors.In order to improve the effect of the family education order system,it is necessary to improve the relevant issues,including specifying the content of the obligation,reasonably establishing the punishment measures for violating the obligation,unifying the time effect of the family education order,and improving the family education guidance system.
