摘要
盗窃进出口货物的案件在天津这种大型港口城市屡见不鲜。在货物吞吐量极大的港口地区,承运公司每天负责运输的货物量较多,在运输过程中失窃的货物通常价值不高,有些甚至不够盗窃罪的立案标准。在“以审判为中心”的办案要求下,想获得能够顺利用于诉讼中将被告人定罪量刑的证据链比较困难,这也导致了公安机关对此类案件的重视程度不足。近两年因疫情原因,进口货物尤其是冷链产品会经过严格消杀后才允许入库流入国内市场,因货物丢失而造成的公共卫生安全风险备受重视。本文报告一起集装箱中部分货物失窃案例,在该案中笔者通过对锁闭集装箱的铅封上遗留痕迹的检验研究,确定了嫌疑人的作案方式,为后期案件的办理提供了证据支持,同时也为确定该类案件中铅封是否被打开过、以何种方式打开提供了检验的方法依据。
Theft of imports and exports is common in large port cities like Tianjin.In port areas with a high cargo throughput,carriers are responsible for transporting an oversized load daily.Goods stolen in transit are usually of low value,and some are not even high enough to qualify for theft.In this case,the supervisor of the transportation company often chooses to bear the loss due to the lengthy investigation cycle and an unsatisfactory result of case handling.Under the requirement of“trial as the center,”it is difficult to obtain the evidence chain that can be successfully used to convict and sentence the defendant;this also led to the public security organs paying insufficient attention to such cases.In the past two years,due to the epidemic,imported goods,cold chain products,will be allowed to enter the domestic market after strict elimination.The public health security risk caused by the loss of goods has attracted much attention.This paper reports a case of partial cargo theft in a container.Through the examination and study of the traces left on the lead seal of the locked container,the author determined the crime mode of the suspect and provided evidence support for the handling of the later case.At the same time,it also provides a method basis for determining whether the seal has been opened in such cases and in what way.
