The Proof Mechanism of Social Dangerous Conditions of Arresting in Telecommunication Network Fraud Crime Cases

在立法和司法实践中逮捕社会危险性条件越来越受到重视,但目前逮捕社会危险性的证明逻辑并不清晰,证明机制有待完善。逮捕社会危险性的证明是依靠基础事实对程序法事实进行的一种推定证明。对电信网络诈骗案件的逮捕情况进行实证分析,发现影响证明逮捕社会危险性的大部分基础事实与逮捕适用具有相关性,法律规范中规定的情形以及办案实践中总结的经验基本符合实证分析结果。完善逮捕社会危险性条件的证明机制,在总体上,应当坚持正当程序原则、比例原则、无罪推定原则;在具体路径上,应当完善各类案件中基础事实的验证,厘清基础事实与社会危险性的证明逻辑。

The social dangerous conditions of arresting have been paid more and more attention to in legislation and judicial practice, but at present, the proof logic of social danger of arresting is not clear, and the proof mechanism needs to be improved. The proof of the social danger of arresting is a presumptive proof of the facts of procedural law based on the basic facts. Based on the empirical analysis of arresting in telecom network fraud cases, it is found that most of the basic facts that affect the social danger of arresting are related to the application of arresting and the situation stipulated in legal norms and the experience summed up in the practice of handling cases are basically consistent with the results of empirical analysis. In order to improve the proof mechanism of social dangerous conditions of arresting, on the whole, we should adhere to the principles of due process, proportionality and presumption of innocence. In the specific path, we should improve the verification of basic facts in all kinds of cases and clarify the proof logic of basic facts and social danger.
