非常规情形下经济法应急保障功能分析

Analysis on Emergency Safeguard Function of Economic Law underUnusual Circumstances

作为经济法的非常态化功能,应急保障主要是在紧急情形下利用全方位宏观调控和市场规制稳定经济发展,维护市场与社会秩序,保障民生。虽然历经多次发展,该项功能已经趋于完善,但每次依然会出现干预不彻底、应对措施不合理等问题。特别是在全球经济环境日渐复杂的当下,正值经济法的应急保障功能全面应用之时,急需展开进一步研究完善。对此,从应急保障功能的常规特点着手,分析了目前经济法中应急保障功能发挥的两大措施,并提出从保障理念、机制、体系和限制等层面进行功能优化。

As the abnormal function of economic law,emergency security is mainly to stabilize economic development,maintain market and social order,and ensure people’s livelihood by using all-round macro-control and market regulation in emergency situations.Although this function has been improved after several times of development,there are still problems such as incomplete intervention and unreasonable response measures.Especially in today's increasingly complex global economic environment,the emergency safeguard function of economic law is being fully applied,which needs further research and improvement.In this regard,starting from the conventional characteristics of the emergency security function,this paper analyzes the two major measures on exerting the emergency security function in the current economic law,and proposes to optimize the function from the aspects of the security concept,mechanism,system and restriction.
