民间舞蹈类非遗继承创新的知识产权协同保护制度构建研究

Construction Research on the Collaborative Protection System of Intellectual Property Rights in the Inheritance and Innovation of Folk Dance Intangible Cultural Heritage

非物质文化遗产继承创新的知识产权协同保护在文化强国建设背景下一直广受社会各界的重视。实践中民间舞蹈类非遗继承创新与知识产权保护协同却存在着利益分配的群体性矛盾、权利归属的分配性缺位、权利保护的垄断性冲突等现实困境。在总结民间舞蹈类非遗作品特点的基础之上,针对民间舞蹈类非遗继承创新和知识产权协同保护的困境,该文提出完善版权登记和司法确权制度以增强权利明确性、从单一式保护到包容性增长以促进利益共享化、明确传播链主体的告知义务以提高传播透明度的制度构建进路,以期为提升民间舞蹈类非遗继承创新质量做出贡献。

The collaborative protection of intellectual property rights in the inheritance and innovation of intangible cultural heritage has been widely valued by all walks of life in the context of the construction of a cultural power.In practice,the inheritance and innovation of folk dance intangible cultural heritage and the coordination of intellectual property protection have some practical difficulties,such as the group contradiction of interest distribution,the distributive vacancy of right ownership,and the monopoly conflict of right protection.On the basis of summing up the characteristics of folk dance intangible cultural heritage works,aiming at the dilemma of inheritance and innovation of folk dance intangible cultural heritage and collaborative protection of intellectual property rights,this paper puts forward the system construction approach of improving the copyright registration and judicial confirmation system to enhance the clarity of rights,from single protection to inclusive growth to promote benefit sharing,and clarifying the obligation of disclosure of the main body of the communication chain to improve the transparency of communication,with a view to improving the quality of inheritance and innovation of folk dance intangible cultural heritage.
