智能时代出版者版权风险与防范之策

Copyright Risks and Countermeasures of Publishers in the Intelligent Era

以人工智能、大数据、云计算等为代表的智能技术改变了作品创作、传播和使用的方式,对出版者的版权治理构成了挑战。新技术环境下,作品的权属复杂化,作品版权状态不明的情形常态化,作品授权成本提高,作品合理使用的边界模糊化,算法推送的版权风险增大。为应对版权风险,出版者需设立专门的版权管理部门,配置专业的版权管理人员,健全版权风险防范的工作机制;在技术上可以引入区块链技术服务,进行作品权属的确认和授权许可,同时建立本单位版权管理的数字化平台;在演绎、剪辑、修改作品或使用多媒体数字化作品前,做好版权的风险防范工作;在利用算法推送作品时要提高注意义务,采用一定的过滤技术自动过滤明显构成侵权的作品。

Intelligent technologies,such as artificial intelligence,big data and cloud computing have changed the way of creation,dissemination and use of works,posing a challenge to the copyright governance of publishers.Under the new technology environment,the ownership of works is complicated,the status of works' copyright is normalized,the cost of works' licensing is increased,the boundary of works1 fair use is blurred,and the copyright risk of algorithm feed is increased.In order to deal with copyright risks,publishers need to set up special copyright management departments,allocate professional copyright management personnel,and improve the working mechanism of copyright risk prevention.In terms of technology,blockchain technology should be adopted to confirm and authorize the ownership of works as well as to establish a digital platform for copyright management.Take precautions against copyright risks before deducting,editing or modifying works or using multimedia digitized works;When algorithm feed is used,caution should be taken,and certain filtering technology should be used to automatically filter the works that obviously constitute infringement.
