摘要
未经村民会议决议的农村集体产权交易合同效力认定在司法裁判中形成了“无效说”与“有效说”两种观点。裁判分歧的产生不利于法律规范适用效果的统一。这一问题的解决之道在于明确未经村民会议决议的农村集体产权交易合同效力认定的规范意旨,充分考虑农村集体产权交易制度改革的现实需求。未经村民会议决议的农村集体产权交易合同不应当一概认定无效,对未经村民会议决议的农村集体产权交易合同效力认定应当进行类型化处理,限定未经村民会议决议的农村集体产权交易合同无效的认定范围,进而为农村集体产权交易的顺利展开提供有力的支持。
The determination of the effectiveness of collective property right transaction contract without the resolution of the villagers'meeting has formed two views of“invalidity theory”and“effectiveness theory”in judicial judgment.The emergence of this judicial difference is not conducive to the unification of the judicial application effect of legal norms.The way to solve this problem is to clarify the normative intention of the effectiveness determination of collective property right transaction contracts without the resolution of the villagers'meeting,and fully consider the practical needs of the reform of rural collective property right transaction system.Collective property right transaction contracts without the resolution of the villagers'meeting should not be deemed invalid,and the effectiveness determination of collective property right transaction contracts without the resolution of the villagers'meeting should be typed and limit the scope of invalidity of collective property right transaction contracts without the resolution of the villagers'meeting,so as to provide strong support for the smooth development of rural collective property right transaction.
