为了提升工程总承包项目合同管理与风险管控能力,必须扭转对施工总承包的思维惯性,形成合同管理与风险管控的意识转变,同时结合《工程总承包示范文本》来识别工程总承包合同中的常见风险,找到相应的风险化解办法。另一方面,由于《总承包管理办法》的效力位阶不高,尚不足以为工程总承包项目合同管理与风险防范提供充分的法律保障,仍需综合运用相应的法律法规来评估法律风险。

In order to improve the ability of contract management and risk management and control of EPC projects,it is necessary to reverse the inertia of thinking about EPC projects,form a change of awareness of contract management and risk management and control,and identify common risks in EPC contracts in combination with the"EPC Model Text",and find corresponding risk resolution methods.On the other hand,due to the low level of effectiveness of the"General Contracting Management Measures",it is still insufficient to provide sufficient legal protection for the contract management and risk prevention of the EPC project,and it is still necessary to comprehensively use the corresponding laws and regulations to assess the legal risk.
