摘要 [研究目的]人脸识别技术的大规模运用深刻改变侦查情报分析的样态,深入分析人脸识别技术应用于侦查情报分析的技术路径和偏差问题,为制定科学适宜的技术规制路线提供决策支持。[研究方法]采用文献分析和案例分析相结合的方法,选取典型的人脸识别技术产品为研究样本,结合侦查实践分析人脸识别技术应用于侦查情报分析的技术缺陷、算法偏见和法律规制缺失等问题。[研究结论]侦查机关运用人脸识别技术应事前开展技术风险评估,建立专业培训、内部监督和事项公开等管理制度,设计层次化的应用审查批准程序,适时出台统一的新型侦查技术应用法律规范。 [Research purpose] The large-scale application of face recognition technology has profoundly changed the pattern of investigation information analysis.It is necessary to further analyze the technical path and deviation of the application of the technology to investigation information analysis,and provide decision support for formulating scientific and appropriate technical regulation route.[Research method] This paper uses the methods of literature analysis and case analysis,selects typical face recognition technology products as research samples,and analyzes the technical defects,algorithm bias and lack of legal regulation of the application of face recognition technology to investigation intelligence analysis in combination with investigation practice.[Research conclusion] Investigation organs should conduct technical risk assessment in advance,establish management systems such as professional training,internal supervision and disclosure of matters,design hierarchical application review and approval procedures,and timely issue unified legal norms for the application of new investigation technologies.
