摘要
随着人工智能的发展,犯罪分子借助大数据和人工智能技术实施犯罪变得尤为常见,这成为人工智能时代刑事侦查工作中的一个难题。近年来,物证技术不断革新与发展,新技术的应用提高了取证工作的科学性与客观性,也促进了我国刑侦司法体制的完善,但当前的刑侦技术在应对人工智能时代的新型犯罪活动方面还存在一些局限性。文章认为,将区块链技术、机器学习、大数据技术等人工智能技术应用到侦查取证工作中,能够突破传统刑侦物证技术的局限,有助于提升取证的真实性和客观性,提高刑侦工作的效能,最终有效地维护司法权威。随着人工智能时代物证技术的迭代更新,智慧物证将对刑事侦查模式产生深刻影响,智能物证技术同智能化分析系统的融合,能够在视频侦查、生物特征识别侦查及情报数据智能研判中,为打击犯罪行为提供新的思路。
With the development of artificial intelligence(AI),it has become especially common for criminals to commit crimes by means of big data and AI technology,which brings more difficulties and obstacles to criminal investigation in the era of AI.In recent years,physical evidence technology,with continuous innovation and development,has played an important role in promoting the scientificity and objectivity of evidence collection and improving the criminal investigation system in China.However,the current criminal investigation technology still has some limitations in dealing with new crimes in the era of AI.This paper points out that the application of AI technology,such as blockchain technology,machine learning technology and big data technology,to the investigation and evidence collection can break through the limitations of traditional physical evidence technology in criminal investigation.It is conducive to improving the authenticity and objectivity of evidence collection,improving the efficiency of criminal investigation,and ultimately effectively upholding judicial authority.With the evolution and innovation of physical evidence technology in the era of AI,intelligent physical evidence technology will exert a profound influence on the criminal investigation mode,and the intelligent physical evidence technology integrated with the intelligent analysis system in video investigation,biometric investigation and intelligent research and judgment of intelligence data can provide a new approach for cracking down on criminal acts.
