论荀子“隆礼重法”思想及对法治国家建设的启示

On Xunzi’s Thought of“Promoting Rites and Emphasizing Laws”and Its Enlightenment to the Construction of a Country under the Rule of Law

随着社会的发展,我国提出了建立法治国家的目标。建立法治国家既要吸取现代法治文明的理念和模式,又要吸取传统法治文化的精华。荀子是战国末期著名的思想家,主张人性恶,强调后天的礼法教育对人的重要影响,提出“隆礼重法”思想。荀子的“隆礼重法”思想主张发挥礼教的作用,力主礼主刑辅,倡导德治和法治的结合,能为法治国家建设提供启示。法治国家建设要立足于优秀传统法治文化,创新出具有中国特色的法治制度和法治精神,切实维护人民群众的基本权利。

With the development of the society,China has proposed the goal of establishing a country governed by the rule of law.To fulfill this goal,we should not only absorb the ideas and models of modern legal civilization,but also absorb the essence of traditional legal culture.Xunzi,a famous thinker in the late Warring States period,who advocated that human nature is the evil and emphasized the important impact of the acquired education of rites and law on human beings,hence proposed the idea of“promoting rites and emphasizing laws”.Xunzi’s thought of“promoting rites and emphasizing laws”advocates giving full play to the role of rites,emphasizes rites as the main punishment and punishment as a supporting tool,and advocates the combination of rule of virtues and rule of law,which can provide inspiration for the construction of a country ruled by law.The building of a country under the rule of law should be based on the fine traditional legal culture so as to create a rule of law system and spirit with Chinese characteristics and earnestly safeguard the basic rights of the people.
