The Value Orientation of Intellectual Property Culture and Its Practical Response in the Process of Chinese Modernization of Legal Governance

当代知识产权制度所秉持的“占有性”个人主义价值取向具有显著的西方社会个体自由与经济理性的人文底色,它在回应后疫情时期尤其是数字时代的密集性挑战上渐显不适应性。中国式法治现代化进程和泛知识产权国际竞争新格局需要站位更高远的价值理念来引领知识产权制度实践。人类命运共同体思想是习近平国家治理思想的核心主张,为新发展阶段我国知识产权文化现代化发展提供了科学而系统的价值取向和实践指引。知识产权价值链上利益相关者应以共存、共赢、共享作为共同体意识回归的逻辑起点和实践共识,以切实的知识产权文化实践路径助力更高水平的知识产权良政善治格局的形成。

The value orientation of“possessive”individualism upheld by the contemporary intellectual property system has a significant humanistic background of individual freedom and economic rationality in Western society,which is increasingly unadaptable in responding to the intensive challenges in the post epidemic era,especially in the digital era.The Chinese modernization process of legal governance and the new pattern of international competition for pan intellectual property need to take a higher position in the value concept to lead the direction of intellectual property’s institutional practice.The idea of a community with a shared future for mankind is Xi Jinping’s core proposition of the idea of national governance,which provides a scientific and systematic value orientation and practical guidance for modernization development of China’s intellectual property culture in the new era.Stake-holders in the intellectual property value chain should take coexistence,win-win and sharing as the logical starting point and practical consensus for the return of community consciousness,and take a tangible intellectual property cultural practice path to help form a higher level of good governance pattern of intellectual property.
