死刑案件法律援助的规范阙如与完善——以《法律援助法》为切入点

On the Vacancy and Establishment of Legal Aid for Cases Pertaining to Death Penalty--Taking the Legal-aid Law as the Starting Point.

死刑案件中法律援助对于犯罪嫌疑人、被告人的诉讼权利保障具有极其重要的意义。但是由于死刑案件法律援助律师准入机制的缺失、相关规范对死刑案件法律援助范围的有所限制以及死刑案件法律援助服务质量控制机制的不完善,造成死刑案件法律援助存在制度漏洞。《法律援助法》完善了死刑案件中法律援助律师的准入制度,扩大了死刑案件应当指定法律援助的范围,初步建立了死刑案件法律援助质量控制机制。《法律援助法》对死刑案件法律援助制度的完善做出了贡献,下一步,可以考虑通过及时出台专门性规范和更新相关规范的方式加以完善。

Legal aid in the death penalty cases is of much importance for the suspects and guarantee for the litigation rights of the defendant.However,because of the lack of access system for lawers in the legal aid of death penalty cases,restriction of relevant norms for the scope of legal aid in the cases and imperfection of controlling system for the service quality of legal aid in the death penalty cases,there are still weaknesses in the system of legal aid in these cases.Legal Aid Law of the people's Republic of China improves the access system of lawyers in the legal aid of death penalty cases,expands the scope of necessary legal aid in the death penalty cases,and preliminarily establishes controlling system for the quality of legal aid in the cases.Although it is true that the Legal Aid Law of the people's Republic of China makes contributions to the amelioration of legal aid system of death penalty cases,there is still room for improvement.In the next step,it is suggested to improve it by issuing special norms and updating relevant standards in time.
