摘要
互联网平台根据消费者设备、消费场所、消费频次等对消费者实施大数据“杀熟”行为,引发了社会公众的不公平感知。新的制度供给总是伴随制度供给成本与社会风险,对大数据“杀熟”行为的治理应辩证处理,以市场在资源配置中的决定性作用发挥为前提,从既有治理缺口处寻得突破;既有治理体系,对大数据“杀熟”造成的个体损害进行较为充分的保护,但对公共利益的保护确存在明显缺口;治理的改进需要以反垄断法为重要抓手,弥补对公共利益保护的不足。
the internet platforms offer big data discriminatory pricing according to devices used by customers,places of consumption,frequency of consumption and so on,which leads to unfair perception of the public.The new institutional supply is always accompanied by institutional supply costs and social risks.Therefore,the governance of big data discriminatory pricing should be handled dialectically,and the decisive role of the market in resource allocation should be taken as the premise to find a breakthrough from the existing governance gaps.The existing governance system adequately protects individual damages caused by big data discriminatory pricing,but there is a clear gap in the protection of public interests.The improvement of governance needs to take the Anti-monopoly Law as an important starting point to make up for the lack of protection of public interests.
