论行为共同说适用的合理性

On the Rationality of Application of Co-action Theory

学界对如何理解共同正犯“共同”的内容存在不同的认识,形成了部分犯罪共同说与行为共同说这两种主流理论。这两种理论目的都在于为适用部分行为全部责任提供理论依据。部分犯罪共同说由于其将有责性的内容纳入到共犯成立的要件而在适用中存在一定弊端,而行为共同说完全能在我国刑法第25条规定的框架下适用,由于其仅将违法性内容作为共同正犯的成立依据,相比于部分犯罪共同说更具有适用合理性。

In the academic circle,there are different understandings on how to understand the nature of the"common"of the co-principal in the joint principal offender,which forms two mainstream theories,the co-theory of partial crime and the co-theory of behavior.The purpose of these two theories is to provide theoretical basis for the full liability of partial behavior.The partial crime community theory has some disadvantages in application because it includes the content of responsibility into the requirements of the establishment of accomplice,while the behavioral community theory is applicable under the framework of Article 25 of Criminal Law in China.Since it only takes the illegal content as the establishment basis of the joint principal offender,it is more reasonable than the partial crime community theory.
