网络隐私权及其行政法保护分析

Research on Internet Privacy and Its Protection by Administrative Law

随着时代的发展,互联网技术被广泛应用于生活的方方面面,但网络互联速度的加快也导致公民网络隐私权被侵犯问题日益突出。传统以私法保护为主的法律体系难以有效防范信息时代隐私侵权问题,从行政法层面加强对公民隐私权的保护,不仅有利于抵御私主体对公民隐私权的大规模侵权,也利于防范公权力主体在互联网中对个人隐私权的侵害,因此有关部门应针对网络隐私权的行政保护法进行探究、完善,确保我国公民的隐私权得到保护。基于此,本文针对网络隐私权保护主体进行分析,并研究了网络隐私权遭受侵犯的主要形式,同时提出了加强网络隐私权行政法保护的具体路径选择建议。

With the advancement of the times,the internet is extensively applied in all aspects of life,whereas the issue of privacy infringement is becoming increasingly pronounced.The traditional legal system based on private law failed to effectively prevent privacy infringement in the information era,while administrative law is not only conducive to curbing cases of infringement by private subjects,but also those by public subjects.Hence,relevant departments should further improve the administrative law to protect Citizens’right to privacy.Based on this,this paper intends to examine the main subjects of network privacy protection,studies the main forms of privacy infringement,and proposes specific paths to strengthen the protection of network privacy.
