云计算平台作为新型网络服务提供者的典型代表,相较传统网络服务提供者,具有大规模、虚拟化、多租户、回避用户内容等特征,已在一定程度上超出了传统避风港原则的制度设计范畴,为著作权侵权责任的认定带来诸多挑战,既有分析视角呈现抽象有余而体系化不足的趋势。云计算平台著作权侵权责任理论应以注意义务为核心要素,而针对用户上传内容不负有审查义务。在IaaS、PaaS、SaaS等不同服务模式下,云计算平台的注意义务边界应当随着控制对象和控制能力的不同有所区分。在认定云计算平台著作权侵权责任时,司法者应当在坚持“通知—必要措施”的基本方法下,实现“比例原则”的具体运用,同时注重“动态调整”的发展趋势。

As a typical representative of new network service providers,compared with traditional network service providers,cloud computing platform has the characteristics of large-scale,virtualization,multi tenant and avoiding user content.To a certain extent,it has gone beyond the system design scope of the traditional safe haven principle,and has brought many challenges to the identification of copyright infringement liability.The existing analysis perspective shows a tendency of being more abstract and less systematic.The cloud computing platform copyright infringement liability theory should take the duty of care as the core element,and there is no obligation to review the content uploaded by users.Under different service modes such as IaaS,PaaS,and SaaS,the boundary of the cloud computing platform's duty of care should be differentiated according to the different control objects and control capabilities.When determining the copyright infringement liability of the cloud computing platform,we should adhere to the basic method of“notification-necessary measures”to realize the specific application of the“proportionality principle”,and pay attention to the development trend of“dynamic adjustment”.
