公安院校行政法学科的内卷化与去内卷化

Involution and De-involution of Administrative Law Discipline in Public Security Colleges

“新文科”“新法学”建设对公安院校行政法学科建设提出了新的要求。当前公安院校行政法学科建设逐渐呈现出内卷化效应,具体表现为过度依赖传统行政法学总论及其建构模式,自我锁定公安院校行政法学科建设的功能,以机械化和过密化的知识训练替换公安院校行政法学科建设的真正目标。在新的历史定位和要求下,公安院校行政法学科应主动求新应变,实现去内卷化发展,即在遵循学科理论和对象理论的基础上,从整个社会规范体系所构造的“学科群”和行政法学自身的具体内容出发,合理把握公安院校行政法学科不同于其他学科建设的角色定位和三级价值导向,并适度调整行政法学科建设的主体范式、行为范式和救济范式。

The construction of“new liberal arts”and“new jurisprudence”puts forward new requirements for the construction of administrative law discipline in public security colleges.At present,the construction of the discipline of administrative law in public security colleges is gradually showing the involution effect,which is manifested in over-reliance on the traditional general theory of administrative law and its construction mode,self-locking the function of the construction of the discipline of administrative law in public security colleges,replacing the real goal of the construction of the discipline of administrative law in public security colleges with mechanized and over-intensive knowledge training.Under the new historical orientation and requirements,the administrative law discipline of public security colleges should take the initiative to seek new changes and achieve de-involution,that is,on the basis of following the discipline theory and object theory,starting from the“discipline group”constructed by the whole social norm system and the specific content of administrative law itself,reasonably grasp the role orientation and three-level value orientation of the administrative law discipline of public security colleges different from the construction of other disciplines,and appropriately adjust the subject paradigm,behavior paradigm and relief paradigm of the discipline construction of administrative law.
