著作权法视野下我国服装设计的保护

The Protection of Clothing Design in China from the Perspective of Copyright Law

我国服装设计的著作权保护存在时尚领域的“盗版悖论”和司法实践的保护困境。从服装设计的著作权属性辨析及作品类型认定、服装实物分类与作品认定之间的关系、根据图纸制作服装是否属于著作权法上的复制3方面看,不同的服装设计作品涉及的各种成果对著作权法的适用情形不同,需区别对待。

There exists a“piracy paradox”and a dilemma in judicial practice for the copyright protection of clothing design in China.Different clothing designs involving various outcomes,to which copyright law applies diversely,require differentiated treatment,in the light of the following three aspects,namely,the discrimination of copyright attributes of clothing design and the recognition of the types of works,the relationship between the classification of physical clothing and the identification of works,as well as whether clothing produced according to drawings is considered as a reproduction under copyright law.
