摘要
积极推进终身教育是新时代推进社会发展模式改革、推进教育改革、建设学习型社会的重要支撑。当前,我国终身教育立法发展缓慢,虽然对终身教育立法和实践进行了积极探索,但层层剖析后显现出顶层规划不完善、现有法律法规缺乏前瞻性和创新性的特点,表现为地位较低、可操作性较弱以及地方立法笼统宽泛、发展滞后等问题。通过对立法范畴之困境、立法规范之困境、立法目标之困境的阐述,呼吁新时代要加强研究队伍和理论的建设,创新教育立法的理念,使终身教育立法由“促进法”迈向“保障法”,以此推动终身教育事业法制化发展。
Actively promoting lifelong education is an important support for promoting social development model reform,promoting education reform,and building a learning society in the new era.At present,the development of lifelong education legislation in our country is slow.Although the lifelong education legislation and practice have been actively explored,the characteristics of imperfect top-level planning and the lack of foresight and innovation in existing laws and regulations have been revealed by layers of analysis.The characteristics are manifested as low status,weak operability,general and broad local legislation,and lagging development.By elaborating on the dilemma of legislative categories,legislative norms,and legislative objectives,this paper calls for strengthening the construction of research teams and theories in the new era,innovating the concept of educational legislation,and moving lifelong education legislation from“promoting law”to“safeguarding law”,so as to promote the legalization of the development of lifelong education.
