Difficulties and Solutions of Personal Information Legal Protection in the Application of Shared Express Packaging

在《个人信息保护法》颁布实施的背景下,共享快递包装的个人信息保护理应得到强化,特别是应从制度层面提供明确的法律依据,但当前仍存在“个人信息处理者”涵盖面不足、监管不力、责任制度缺失等制度困境,成为阻碍共享快递包装推广应用的重要因素。故而,应加强与《个人信息保护法》的衔接,从拓展个人信息处理者涵盖范围、完善监管体系、细化法律责任制度等方面着手,破解共享快递包装应用中的个人信息保护困境,推动实现物流行业绿色发展。

Under the background of the promulgation and implementation of the Personal Information Protection Law,the personal information protection of shared express packaging should be strengthened,especially from the institutional level.However,there are still some institutional dilemmas,such as insufficient coverage of“personal information processors”,weak supervision and lack of responsibility system,which have become important factors hindering the popularization and application of shared express packaging.Therefore,it is necessary to strengthen the connection with the Personal Information Protection Law,expand the coverage of personal information processors,improve the supervision system,refine the legal liability system and other aspects to solve the personal information protection dilemma in the application of shared express packaging,and promote the green development of logistics industry.
