摘要
由于我国法律未对劳动者的概念作出明确界定,学术界对此也存在较大分歧,因此十分有必要明确劳动者身份认定的标准,以确定实习大学生与用人单位之间的法律关系。并以此为基础,从人身损害赔偿与薪酬标准两个角度,结合国情,探究对实习大学生劳动权益的保护路径,以完善我国大学生实习期间劳动权益的保护体系。
As China's law does not make a clear definition of the concept of the laborer,the academic community is also very different,so it is necessary to clarify the standard of the identification of the laborer,in order to deter-mine the legal relationship between college students and employers.And on this basis,from the personal injury compensation and salary standards of the two perspectives,combined with the national conditions,to explore the way to protect the labor rights and interests of college students in practice,in order to improve the protection system of labor rights and interests of college students in Practice.
