“The Metaverse Society”:Inner Logic and Legal Governance

元宇宙归根结底是一个以数字人为主体、具有虚拟实在性的数字虚拟社会。作为虚拟社会的元宇宙也是社会的一种,且与现实社会之间高度嵌套、相互构造,而非独立于现实世界的平行世界。元宇宙社会的底层逻辑是虚实交互、人机互融、游戏范式和用户共创内容。元宇宙的架构化重新构造了社会行为、社会结构和社会关系,同时也彻底改变了法律的调控进路,元宇宙中的社会关系和法律关系都将基于数字人主体而展开。尽管如此,但并没有为元宇宙社会构建单独法律秩序的必要,它仍然应该接受现实法律治理体系的统一干预。法律对元宇宙社会的治理,不是法律与代码技术的二元共治,而是借助代码技术实现法律的代码化预嵌与算法化运行。与此同时,去中心化治理的实现不单单取决于元宇宙背后的技术支持和价值倾向,更重要的是,在现实社会探索一种从中心化到去中心化的法律治理机制之转型的可能路径。

In essence.the Metaverse is a digital virtual society with digital humans as the main body and having features of virtual reality.As a virtual society,the Metaverse is also a kind of society,and is highly nested and mutually constructed with the real society.rather than a parallel world independent of the real world.The underlying logic of the Metaverse society is virtual real interaction,human com puter integration,game paradigms,and user co-creation of content.The structuring of the Metaverse reconfigures social behavior,social structure,and social relations,while also revolutionizing the regula tory approach of law;the social relations and legal relations in the Metaverse are based on digital hu­mans as the main body.Nonetheless,there is no need for a separate legal order for the Metaverse socie­ty.It should still accept the unified intervention of the real legal governance system.The governance of law over the Metaverse society is not the dual co-governance of law and code technology,but the code embedding and algorithmic operation of law with the help of code technology.At the same time,the re­alization of decentralized governance depends not only on the technical support and value orientation behind the Metaverse,but more importantly,on exploring a possible path of transformation from a centralized to a decentralized legal governance mechanism in the real world.
