知识产权惩罚性赔偿与法定赔偿的协调适用

The Coordinative Application of Punitive Compensation and Statutory Damages for Intellectual Property Rights

知识产权惩罚性赔偿制度自引入至今一直存在着适用不足的问题,而法定赔偿不仅挤占惩罚性赔偿计算基数的适用空间,还代行惩罚功能,二者之间缺乏清晰界限,造成适用关系的混乱。惩罚性赔偿与法定赔偿适用关系主要有单一模式、分立模式、融合模式三种,目前我国知识产权主要法律均采用分立模式,经分析融合模式才更符合我国实际。适用融合模式,首先要放弃高精度期待并采用综合性计算方法,其次要保留法定赔偿的效率优势,再次确定回归补偿性本质的法定赔偿可作为惩罚性赔偿的计算基数,最后是理清惩罚性赔偿的实践逻辑。

Since the introduction of the punitive damages system for intellectual property rights,there has been a problem of inadequate application,while statutory damages not only squeeze the application space of calculation basis for punitive damages,but also act as a substitute for the punitive function,and the lack of clear boundaries between the two has caused confusion in the application relationship.There are three main types of relationship between punitive damages and statutory damages:single,discrete and fusion.At present,discrete mode is mainly adopted in main laws of intellectual property right,but analysis show fusion mode is more suitable for practical reality in China.In order to apply the fusion model,firstly,the high precision expectation should be abandoned and a comprehensive calculation method should be adopted;secondly,the efficiency advantage of statutory compensation should be retained;once again,it should be determined that statutory compensation,which has returned to its compensatory nature,can be used as the basis for calculating punitive compensation;and finally,the practical logic of punitive compensation should be clarified.
