建立健全监察赔偿制度

Establish Sound Monitoring Compensation System

在监察体制改革背景下,监察赔偿是制约监察权的关键一环,但我国现行法律对监察赔偿制度未作具体规定,《监察法实施条例》对监察赔偿的规定也并不全面。因此,有必要将人民主权学说国家责任理论以及权利救济理论作为理论基础,在《国家赔偿法》中设专章规定监察赔偿制度的归责原则、赔偿范围、赔偿义务主体以及具体程序,建立健全监察赔偿制度,以贯彻落实依法治国战略、完善监察法律体系、有效规范监察机关权力行使以及切实保障人权,从而促进监察体制改革法治化,保证监察权一直在法治轨道内运行。

In the context of the reform of the supervisory system,supervisory compensation is a key part of restricting supervisory power.However,the current laws of our country do not specify the supervisory compensation system,and the Regulations for the Implementation of the Supervision Law are not comprehensive.It is necessary to take the theory of people’s sovereignty,the theory of state responsibility and the theory of rights relief as the theoretical basis,and set up a special chapter in the“State Compensation Law”to stipulate the principle of attribution,the scope of compensation,the subject of compensation obligations and the specific procedures of the supervision compensation system,and establish and improve the supervision compensation system.In order to implement the strategy of ruling the country according to law,improve the supervision legal system,effectively regulate the exercise of power of supervision organs,and effectively protect human rights,so as to promote the reform of the supervision system and the rule of law,and ensure that the supervision power has been operating within the track of the rule of law.
