完善我国涉港民商事案件司法文书送达机制的几点思考

Some Thoughts on Improving the Service Mechanism of Judicial Do cuments in Civil and Commercial Cases Involving Hong Kong SAZ in China

内地与中国香港之间的送达,系“一国”之内的区际送达,既不同于内地各省之间的送达,也有别于国与国之间的涉外送达。目前,参照涉外送达规则建立的涉港民商事案件司法文书送达机制,既不能充分发挥“一国两制”优势,也难以适应涉港司法实践新需求,造成送达效率和送达成功率较低、送达途径不对等、送达主体单一等困境,严重制约涉港民商事审判质效。为此,建议在“一国”之内构建一套有别于涉外送达的灵活高效便捷的涉港民商事案件司法文书送达机制,通过优化送达程序、拓展送达方式、扩大送达主体等举措,有效实现两地送达规则深度衔接。

Service between the mainland and Hong Kong SAZ refers to interregional service within a"one country",which is different from service between mainland provinces and foreign related service between countries.Currently,the judicial document service mechanism for civil and commercial cases involving China Hong Kong SAZ established with reference to the foreign-related service rules cannot fully utilize the advantages of"one country,two systems",nor can it adapt to the new needs of judicial practice involving Hong Kong SAZ,resulting in low service effi ciency and success rate,unequal service channels,and a single service subject,which seriously restricts the quality and eff ectiveness of civil and commercial trials involving Hong Kong SAZ.Therefore,it is recommended to establish a flexible,efficient,and convenient judicial document service mechanism for civil and commercial cases involving Hong Kong SAZ within the"one country",which is different from foreign-related service.Through measures such as optimizing the service process,expanding service methods,and expanding the service subject,it is effective to achieve in-depth convergence of the service rules between the two places.
