党内法规治理效能分析:理论阐释及实现路径

The Governance Efficiency of the Party Laws and Regulations:Theoretical Interpretation and Realization Path

在国家治理能力与治理体系现代化背景下,治理效能的概念表达不仅指向治理实效,而且具有潜在性与现实性两层维度,天然契合了现代民主政治与党内法规的价值意蕴。基于此,对党内法规治理效能的学理化透视应结合中国共产党的治理实践,以内部视角廓清其生成要素与运行结构,以外部视角与类型化思维塑造其在法治中国建设中的基本样态。目前党内法规体系已经比较完善,实现其治理效能需要关注规范体系的理性建构与落实保障之间的良性互动,尤其要侧重建立实施执行与评估反馈的制度机制,推动党规之制向党规之治的转变。

In the context of the modernization of national governance capacity and governance system,the concept of governance efficiency does not only point to the effectiveness of governance,but has two dimensions:potential and reality,which is in line with the value of modern democratic politics and the Party laws and regulations.Combined with the governance practice of the Communist Party of China,the theoretical interpretation of the governance efficiency of the Party laws and regulations needs to clarify its generation factors and operating structure from an internal perspective,and shape its basic form in the construction of rule of law in China from an external perspective and typological thinking.At present,the Party laws and regulations system has been relatively perfect,but to achieve its governance efficiency,it is necessary to pay attention to the benign interaction between the rational construction of the normative system and the implementation,especially the establishment of an institutional mechanism for implementation,evaluation and feedback,so as to promote the transformation of the system of the Party regulations to the rule of the Party regulations.
