文本与实践:美国、日本儿童法治教育的经验镜鉴 被引量:1

摘要 儿童是国之未来与根柢。儿童法治教育则攸关“无规矩不成方圆”之初始习惯养成,攸关健全法律人格之基础性形成,攸关社会主义各项事业之奠基。我国通过道德与法治这一学科性课程的设置、法治副校长制度的推行、儿童系列法治教育宣传活动的践行等,虽在儿童法治教育领域取得了斐然成绩,但在推行过程中存在公民性人格与个体性人格型塑的欠缺、课程体系设置与教材编排的合理性欠佳等问题。我们可借鉴美国与日本的有益经验,在重视儿童公民性人格与个体性人格塑造时,形成“S+L+J”新型培育机制,并配套《道德与法治》教材的优化,以革新我国的儿童法治教育。 Children are the future and fundamental of a nation.Children’s legal education relates to the formation of the initial habit of“no rules,no justice”,the foundation of legal personality,and all sectors of the socialist undertakings.China has rich experience in the law education for children,including the setting of the disciplinary curriculum of Morality and Rule of Law,school’s vice-president in charge of legal education,and numerous activities designed for legal publicity,which has made remarkable achievements.However,we should learn from the experience in the United States and Japan due to the lack of shaping citizen personality and individual personality in children’s legal education,the inadequacy of curriculum system setting and textbook arrangement.When attaching great importance to the shaping of children’s civic personality and individual personality,a new cultivating model of‘S+L+J’has formed,and the teaching textbook Morality and Rule of Law has been optimized to innovate the children’s legal education in China.
