农村地区非法集资的治理及对策研究

近年来,社会上出现了一些非法集资案件,其中针对农村地区居民的非法集资活动数量占比颇高,这些非法集资犯罪隐蔽性强、波及人数多、涉案金额大,给农民造成了严重的经济损失。其原因在于农村是熟人社会,牵一发而动全身,并且农村地区居民投资渠道少、法律意识淡薄、重人情而轻法律,同时,我国在刑事立法理论和基层司法机关实践中针对非法集资犯罪也存在一些问题。因此,针对农村地区非法集资犯罪,应完善金融法、刑法等相关法律法规,加强对农村民间金融的监督管理,加大法律及金融知识宣传力度,进而推动对农村地区非法集资的治理。

In recent years,a number of illegal fund-raising cases have erupted in society,with a high proportion of illegal fund-raising activities targeting residents in rural areas.These illegal fund-raising crimes are highly covert,involve a large number of people,and involve a large amount of money,causing serious economic losses to farmers.The reason lies in the fact that rural areas are a society of acquaintances,a slight move in one part may affect the situation as a whole,in addition,there are few investment channels for rural residents,weak legal awareness,and the emphasis on human relations over the law.At the same time,there are also some problems in China's criminal legislation theory and grassroots judicial practice against illegal fund-raising crimes.Therefore,in response to the crime of illegal fund-raising in rural areas,it is necessary to improve relevant laws and regulations such as the financial law and criminal law,strengthen the supervision and management of rural folk finance,increase the publicity of legal and financial knowledge,and promote the governance of illegal fund-raising in rural areas.
