完善长江流域蓄滞洪区管理立法思考

Reflections on Perfecting Management Legislation of the River Flood Storage and Detention Area in Yangtze River Basin

健全长江流域蓄滞洪区管理法规体系,是保障流域防洪安全、促进区内经济社会协调发展的必然要求。随着长江流域经济社会的发展,部分蓄滞洪区产业布局失衡、防洪工程建设迟缓的现状与防洪保安之间的矛盾日益凸显。在梳理总结长江流域蓄滞洪区运用与管理中存在问题的基础上,从推进《蓄滞洪区管理条例》制订、加强蓄滞洪区洪水影响评价管理配套法规建设以及修订《蓄滞洪区运用补偿暂行办法》三个维度提出了立法建议,对于进一步规范长江流域蓄滞洪区管理以及完善我国蓄滞洪区法规体系,具有现实意义。

Developing a sound regulatory system for managing the retention and detention areas in the Yangtze River Basin is a necessary requirement for ensuring flood control safety and promoting coordinated economic and social development within the region.With the economic and social development in the Yangtze River Basin,the contradictions between the unbalanced industrial layout,the slow flood control engineering construction in some retention and detention areas and flood control security have become increasingly prominent.We first analysed the problems in the management and use of retention and detention areas in the Yangtze River Basin.On this basis,we put forward legislative suggestions from three dimensions:promoting the formulation of the Regulations on the Management of Retention and Detention Areas,strengthening the construction of supporting regulations for flood impact assessment management in retention and detention areas,and revising the Interim Measures for Compensation of the Use of Retention and Detention Areas.These proposals are of practical significance for further regulating the management of retention and detention areas in the Yangtze River Basin and improving the regulatory system for retention and detention areas in China.
