Making of a Sound Inner-Party Regulation System: Standards, Routes and Concerns

我们党业已“形成比较完善的党内法规体系”,今后的任务是建设更加完善的党内法规体系。但是“完善的党内法规体系”的判断标准是什么?今后的努力方向在哪里?这无疑是十分重要的问题。基于对权威论述的分析,我们认为,党内法规体系是否完善取决于以下四个方面:一是党内法规制度规范体系是否完善;二是党内法规制度实施体系是否高效;三是党内法规制度保障体系是否有力;四是党内法规制度的规范体系、实施体系与保障体系是否有机统一。只有真正做到规范健全,实施到位和保障有力,且三者相互支持,有机统一,才会形成完善的党内法规体系。进一步构建完善的党内法规体系的基本途径有三个:一是创新党内法规体系框架;二是推动党内法规集约化;三是实现党内法规法典化。在这个过程中,要注意避免落入钱穆制度陷阱,要更加注重解决突出问题,要更好地平衡约束和激励的关系。

Our Party has“formed a relatively perfect system of inner-Party regulations”,and the task ahead is to build a perfect system of inner-Party regulations.However,what are the judgment criteria for a“perfect system of Party regulations”,and what is the direction for the efforts to make?These undoubtedly are very important issues.Based on an analysis of authoritative arguments,our consideration is that the perfection of the system is decided by the following four factors:1.The perfection of inner-Party regulatory mechanism,2.The effectiveness of the implementation of inner-Party regulations,3.The power of inner-Party guaranteeing system,4.The organic correspondence between the upper three factors.A perfect inner-Party regulation system can only be formed with a sound regulatory mechanism,proper implementation and powerful guarantee system,the three mutually supporting each other.Three routes lead to further perfection of inner-Party regulation system:creating a framework for inner-Party system,collectivizing inner-Party regulations,and codifying such regulations.In this process,we should pay attention to avoiding falling into the trap of Qian Mu system,to solving prominent problems,and better balance the relationship between constraints and stimulations.
