党内法规权威的内涵属性、生成机制与实现路径

党内法规权威强调党内法规具有不令自行的强大影响力,能够得到党组织和党员甚至党外群众的普遍认同、自觉服从和信仰。党内法规权威的生成机制包括动力机制、支撑机制和保障机制。其中,动力机制是指党内法规始终坚持党的领导、保障党内民主;支撑机制是指党内法规具有法属性;保障机制则指向党内法规的实施。党内法规权威不仅有助于推进全面从严治党、维护党中央权威和集中统一领导,还能够完善依规治党,实现依规治党和依法治国的有机统一,同时也是加快党的自我革命制度规范体系建设的助推器。为此,应当从坚持和加强党的领导、健全党内法规体系、强化党内法规实施入手,全面建构党内法规权威,不断提升党内法规效力,从而实现依法治国和依规治党的有机统一。

The authority of inner-Party regulation means the inner-Party regulation enjoys high prestige in the process of the leadership and construction of the CPC,and is obeyed,recognized and believed by all CPC members and even the masses outside the Party.The authoritativeness of inner-Party regulations has a generative mechanism that includes the motivation mechanism,supporting mechanism and guaranteeing mechanism.The motivation mechanism refers to their adherence to the Party leadership and safeguarding inner-Party democracy.The supporting mechanism refers to the legal attributes of such regulations.The safeguarding mechanism points to the implementation of these regulations.The authoritativeness of inner-Party regulations helps with the wholesale promotion of comprehensive and strict administration of the Party,the maintenance of Central Party Committee’s authoritative and collective leadership;it also helps realize the organic unification of Party administration according to regulations and state governance according to the law;it at the same time accelerates the construction of the regulation system for the Party’s self-revolution.Therefore,the authoritativeness of inner-Party regulations must be comprehensively constructed from such aspects as strengthening and consolidating the Party leadership,perfecting the regulation system and improving their implementation so that their effectiveness can be continuously improved to facilitate the unification of Party administration with state governance by law.
