董仲舒“春秋决狱”的儒法交涉

Research on Dong Zhongshu's Invoking Legalist theories into Confucianism in"Adjudging Case by Chunqiu"

迄今,学界对董仲舒学说及其思想已有较多研究,对“春秋决狱”也有较高关注。但对董仲舒与法家的关系、董仲舒思想中的法家渊源以及所呈现的法家思想痕迹的探析,并没有太多涉及。“春秋决狱”是儒家经典学说指导司法实践的一项重要原则,现存于《通典》《白帖》和《御览》中的六个案例是研究董仲舒“春秋决狱”问题的重要文献资料。董仲舒以“原心定罪”“亲亲相隐”“诛首恶”“罪同异论”等《春秋》经义来审判司法案件,实际上是对儒家意旨与法家刑律的有机结合。所以,本文旨在从“春秋决狱”案例的具体分析出发,对董仲舒在其中的儒法交涉进行一定的阐发。

Up to now,there have been many studies on Dong Zhongshu's Doc-trines and thoughts,and there are also many attentions on"Adjudging Case by Chunqiu".However,the relationship between Dong Zhongshu and legalism,the origin of legalism in his thoughts and the traces of legalism in his thoughts have not been discussed too much."Adjudging Case by Chunqiu"isan.important principle that Confucian classical theory guides judicial prac-tice.The six cases that exist in the"Tong Dian","Bai Tie",and"Yu.Lan"are important literatures to study Dong Zhongshu's"Adjudging Case by Chunqiu".Dong Zhongshu tried judicial cases with the prineiple from"Chun Qiu",which was in fact an organic combination of Confucian intent and legal-ist law.Therefore,the starting point and focus of this paper lies in the fur=ther research on Dong's"Adjudging Case by Chunqiu"to expound the connec-tion between Confucianism and Legalism in his thought.
