摘要
由人大及其常委会监督监察委员会是国家的一项重要宪制安排,其目的在于防范和化解监察委员会滥用权力的风险。由于在制度和实践中尚未处理好监察权依法独立行使与人大有效监督等关系,导致人大及其常委会监督监察委员会时容易出现抽象监督与具体监督的两难抉择,需要为人大及其常委会监督监察委员会划定合理界限。在合理划分监督界限上,应坚持类案监督,避免个案监督;坚持程序监督,避免结果监督;坚持实质监督,避免形式监督。
The supervision of State Committee of Supervisory of P.R.C by the National People’s Congress and its Standing Committee,is an important constitutional arrangement in China,with the purpose of preventing the abuse of power.However,due to the fact that we have not properly dealt with the relationship between the independence of supervisory power and the supervision of the National People’s Congress,the NPC and its Standing Committee faced the dilemma of abstract supervision and specific supervision.Therefore,we need to draw a reasonable boundary for the supervision of State Committee of Supervisory of P.R.C by the NPC and its Standing Committee.Specifically speaking,we should insist on“typical case supervision”and avoid“individual case supervision”;we should adhere to“procedure supervision”and avoid“result supervision”;we should adhere to“substantive supervision”and avoid“formal supervision”.
