法礼融合下的乡村基层纠纷解决机制研究--以诉源治理为视角

Research on the Rural Dispute Resolution Mechanism with an Integration of Law and Rite from the Perspective of Governance of Litigation Source

进入现代社会以来,虽然我国传统社会结构发生了巨大变迁,法律、行政命令在国家治理中扮演着基础性作用,但乡村基层纠纷解决及基层秩序生产仍需依靠礼治等非正式规则。因此,从本质上来看,当前乡村基层治理仍然是法治与礼治共同作用的结果,乡村社会秩序的运行规则仍是礼法并行。诉源治理的提出,不仅是因司法行为本身的结构性矛盾,也因部分案件在流入司法机关后的处理结果并未达到预期的社会效果。因此,兼具法治与礼治的多元化纠纷解决机制,能更好地融合法礼两种规则,实现相对正义,从而使秩序生产成为可能,并实现乡村社会的善治。

In the modern society,the disputes are still settled and the order is still kept through informal rules such as etiquettes in rural areas despite the tremendous changes in the traditional social structure China has undergone and the fundamental role the laws and the administrative orders play in the national governance.Therefore,in essence,the current governance in rural areas is still under the rule of both law and rite which also work together to keep the social order there.The proposal of Governance of Litigation Source is not only due to the structural contradiction of judicial behavior,but also due to the fact that some cases failed to achieve the expected social effect with the handling of the judiciary.The diversified dispute resolution mechanism can integrate law and rite to achieve relative justice,so as to help to keep the social order and realize the effective and harmonious governance in the rural areas.
