城市更新项目法律风险分析及规避策略研究

摘要 随我国工业化、城市化进程快速推进,全国大中城市尤其核心城区土地供需矛盾日趋加剧。近年来,城市更新作为对城市空间再分配再利用的一种有效模式,可有效解决我国城市化进程中出现的各种问题,在各地积极推进并获得普遍认可,目前城市更新已上升为国家战略。城市更新涉及主体较多,不同于普通房地产开发,也不同于寻常民商事投资,法律关系呈现多元化和复杂化。笔者从城市更新概念、历史沿革及立法现状等角度出发,立足于项目实践,从法律从业者角度梳理城市更新项目存在的主要法律风险,并给出相应规避策略,希望能对城市更新项目法律风险防范工作有所裨益。 With the advancement of industrialization and urbanization in China,the contradiction between supply and demand of land in large and medium-sized cities,especially in the core urban areas,is growing.In recent years,urban renewal,as an effective model for redstribution and reuse of urban space,can effectively solve the problems arising in the process of urbaniation in China,and it has been actively promoted in various regions and has been widely recognized.At present,urban renewal has also beome a national strategy.Urban renewal involves many subjects,which is different from ordinary real estate.development and ordinary civil and commercial inestment.The legal relationship is divensified and complex.From the perspective of the concept,historical evolution and legislaive status of urban renewal,based on the project practice,the author combs the main legal risks of urban renewal projects in the sight of legal practitioners,and gives coresponding avoidance strategies,boping to be beneficial to the legal risk prevention of urban renewal projects.
