摘要
甘丹颇章时期贵族婚姻的契约文献中,记载了诸多贵族婚姻的财产分配及保护问题。诸如规定了贵族初婚必须签定婚姻契约,离婚按亲属离异律(Nye-Vbrel-Vbral-Sdum-Gi-Zhal-Lce)判定双方的权利与义务,婚姻需获地方政府承认等,反映出贵族婚姻已然形成攀权附贵之风,为有效地保护贵族婚姻存续间的财产问题与阶级地位,贵族婚姻契约应运而生,形成了一种婚姻等级制度。
There were many problems of property distribution and protection in the contract documents of noble marriage in the period of Dga-ldan-pho-brang.Such as making a marriage contract mandatory for the first marriage of a nobleman,confirming the rights and obligations of both parties according to the law of family divorce(Nye-’brel-’bral-’dum’gyi-zhal-lce),and allowing the marriage to be recognized by the local government.In order to effectively protect the property and class status during it,the aristocratic marriage contract came into being and formed a marriage hierarchy.
