摘要
生态环境损害赔偿磋商性质定位一直是各家争论的焦点,其中民事说过于关注磋商的形式平等,行政契约说缺乏意思表示基础,协商行政说与规范性文件存有冲突,双阶层说陷入非公即私的窠臼。磋商过程中环境私益处分不可避免性及行政主导性可为生态损害赔偿磋商协商行政定性提供正向理论支撑。通过疏解磋商过程中行政因素注入之困惑,并且回应司法确认制度缘何可适用于协商行政性质下生态赔偿磋商制度的质疑,进而从正向支持和消解冲突两方面,为生态赔偿磋商协商行政之应然定性提供法律进路。
The nature of consultation on compensation for ecological environment damage has been a hot topic for a long time:The civil theory pays too much attention to the formal equality of negotiation;the administrative contract theory lacks expression of intention;the consultative administration theory contradicts the normative documents;the two-step theory is confined to dichotomous conception of the public-private distinction.The environmental private interest punishment and administrative dominance in consultation can support the administrative characterization of negotiation on compensation for ecological environment damage.Through explaining the administrative factors in consultation and the reason why the judicial confirmation system is applicable to the Ecological Compensation Negotiation System under the consultative administration,the paper provides a legal approach from perspectives of positive support and contradiction resolution.
